If employed, I understand and agree that such employment may be terminated at any time, without prior notice, and that my employment will not be governed by any expressed or implied contract but is at-will.
I agree that, except as set forth in the last sentence of this paragraph, any controversy or claim arising out of or relating to my application for employment or arising out of my employment or termination of my employment including, but not limited to, any controversy or claim based on contract or tort common law and any federal, state or local statute of law, shall be finally settled by binding arbitration administered by the American Arbitration Association under its National Rules for the Resolution of Employment Disputes. The arbitration will be conducted in the state of Florida. Judgment upon any award or decision rendered in an arbitration proceeding may be entered in any court having jurisdiction thereof. Any controversy or claim subject to arbitration shall be deemed waived, and shall forever be barred, if arbitration is not initiated within one (1) year after the date the controversy or claim first arose. Any award by the arbitrator (s) shall be accompanied by a statement of the factual and legal bases for the decision or award. This agreement to arbitrate shall not apply to claims arising out of or related to misappropriation, misuse or unauthorized disclosure of Data Transfer Solutions' trade secrets or confidential information. This agreement to arbitrate is binding on the applicant, employee or employer.
SEVERABILITY: All terms in this application are to be enforced irrespective of whether any term is found to be unenforceable.
